1. Acceptance of Terms

By accessing https://dynbox.co ("Service"), you agree to be bound by these Terms. Continued use constitutes acceptance of future revisions.

2. Service Description

Dynbox provides cloud storage with AI-powered file organization:

  • Automatic file synchronization & sorting using Google Gemini AI
  • Free Plan: 5.0 GB storage, 50 AI credits/month
  • Pro Plan ($10/month): unlimited storage, 1,000 AI credits/month
  • Data stored in Cloudflare R2 with Neon DB infrastructure

3. AI Processing

3.1 File Analysis

Our AI must temporarily process file contents to:

  • Automatically categorize documents
  • Generate metadata tags
  • Suggest organizational patterns

3.2 Data Usage

  • No Training Data: User files never used for AI model training
  • Temporary Processing: Files deleted from memory after 72h
  • Encrypted Analysis: All AI operations use TLS 1.3 encryption

4. User Obligations

4.1 Content Responsibility

You retain ownership but grant Dynbox:

  • Non-exclusive license to process files for Service delivery
  • Right to remove prohibited content per Section 4.3

4.2 Prohibited Content

You may not store:

  • Illegal or infringing material
  • Malware/exploits
  • Content violating third-party rights

5. Payment Terms

5.1 Pro Plan Features

  • Recurring $20 charge every 30 days
  • Unused AI credits don't roll over
  • 7-day refund policy for first subscription

5.2 Free Plan Limits

  • Max 100 files/month for AI sorting
  • 10MB/file size limit
  • Bandwidth throttling after 5GB/month

6. Data Handling

6.1 Storage & Security

  • AES-256 encryption at rest (Cloudflare R2)
  • Zero-knowledge encryption for sensitive documents
  • Regular security audits on Neon DB

6.2 Deletion Policy

  • Free accounts: Data deleted after 90-day inactivity
  • Pro accounts: 30-day recovery window post-cancellation

7. Third-Party Services

We rely on:

  • AI Models: Google Gemini API
  • Infrastructure: Cloudflare R2, Vercel, Neon DB
  • Outages in these services don't constitute SLA breaches

8. Liability & Disclaimers

8.1 Service Limitations

  • No warranty for AI categorization accuracy
  • Maximum liability = 6 months of service fees

8.2 AI-Specific Disclaimers

  • Outputs may contain inaccuracies
  • Human verification recommended for critical files

9. Modifications

We may update these Terms with 30 days' notice via:

  • Dashboard banner (7d pre-effective)
  • Email to account holders
  • Updated "Last Updated" date

10. Governing Law

Disputes governed by French law. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France. Mandatory arbitration required before litigation.

11. Age Restrictions

Users must be 16+ (13+ with parental consent under COPPA).

13. Dispute Resolution

Any dispute arising from these Terms will be resolved through binding arbitration administered by the International Chamber of Commerce (ICC) under its arbitration rules. The arbitration will be conducted in English, in Paris, France.

You may opt-out of arbitration within 30 days of accepting these Terms by sending an email to legal@dynbox.co with "Arbitration Opt-out" in the subject line. The email must include your full name and email address associated with your account.

The arbitration will be conducted by a single arbitrator. The arbitrator's award will be binding and may be entered as a judgment in any court of competent jurisdiction.
